The Employment Non-Discrimination Act Protects LGBT Workers

Surprisingly, there is no federal law in place to prevent discrimination within the workplace against lesbian, gay, bisexual or transgender employees (“LGBT”). Even at state level, laws are inconsistent and in the majority of the country fail to adequately protect individuals from discrimination based upon sexual orientation or gender identity. The Employment Non-Discrimination Act (“ENDA”) will change all that; and will provide protection to those minority groups such as LGBT employees who have so far been overlooked by existing anti-discrimination legislation.

  • Supplementing existing civil rights legislation, the bill is intended to provide all individuals protection against all unjustified discrimination within the workplace.
  • The bill will also outlaw so called ‘positive discrimination’ in the form of preferential treatment and quotas. Disparate impact suits are also addressed in the bill.
  • Small business, the military and religious organizations remain exempt from the provisions of the ENDA.

In terms of support for protecting LGBT employees, polls suggest that two-thirds of voters are in favor of legislation. In business, 88% of the companies listed on the Fortune 500 already have policies in place to protect the rights of LGBT employees. This was reflected politically when ENDA was approved by the Senate on November 7, 2013.
