Transgender Employees are Protected Against Discrimination

In December 2014, the U.S. Justice Department struck down another barrier to equal employment rights for transgender individuals. In a reversal of previous policy, Attorney General Eric H. Holder Jr. issued a memo to all U.S. attorneys stating that discrimination on the basis of gender identity falls under the prohibition of sexual discrimination.

At present, this new stance affects only public employees, as the Justice Department has no authority over private sector employers. If you have concerns in this area, our L.A.   • In 2012 Mia Macy was accepted for a job with the Bureau of Alcohol, Tobacco, Firearms and Explosives pending a background check. The offer was withdrawn on the grounds that budget cuts had eliminated the position, but Ms. Macy later discovered that the job indeed had  been filled. The Equal Opportunity Employment Commission issued a ruling allowing her to proceed with a complaint alleging gender-based discrimination.
  • An executive order signed by President Barack Obama in July 2014 prohibits discrimination against transgender federal employees and holds federal contractors to the same standard. The President denounced the fact that employment discrimination based on sexual orientation and gender identity still exists and expressed the urgency of addressing this injustice.
